According to the Marriage Laws Amendment Bill that is going to be amended soon in the coming monsoon session, the wife will get an equal share in the husband’s inherited or inheritable marital property on divorce. However the exact amount in percentages is not quantified. But the question is not about the figure or the concept of including properties in divorce. The question is whether by including the provision of equal inheritance of property in case of divorce is promoting the institution of female dependence on male or it will improve economic security of an abandoned woman or is it a discouraging move in an era where we encourage the self-esteem of woman to become financially independent? Certainly a bewildering question, isn’t it?The law that will enable a wife in acquiring 50% of residential property in the case of divorce is a too faced act. The employment opportunities are feeble and the income is comparatively lesser than the male counterpart. In this situation if the wife gets a share in inherited property then it will make her life easy and livable and aid in bringing up the child.The supporters of this law say that alimony is not charity but a right of the wife to get the share in the property. Marriage affects the career of a woman. Same thing happens at the time of child birth when the mother has to leave everything to care for the baby. The husband continues his career but the wife leaves everything. If they dissociate then the career possibilities of the wife deteriorates considerably and in around 85 percent of the cases, separated women bear the burden of looking after their children single-handedly. This is a troublesome condition and if equal share is divided then the divorced wife shall be able to continue the life in a stable financial state.Second face is not saintly but questions and debates the point of law. It questions if in a time when the women are emerging none less than any men, when the feminists are promoting the need of self dependence; is giving a share is an indicator of weakness of womanhood? Doesn’t it tell the women that they are weak in compared to men and so you should get the money to live from your husband? Doesn’t it question the self respect of a woman? There can be cases when a woman is forced to marry a wealthy party just to end up with the divorce and the property.But this face is more of a feminist than realist because in reality thousands of women suffer due to divorce which makes them economically poor and bare handed.
