The word ‘license’ has been defined as where one person gives permission to another person, or to a definite number of other persons the right do or continue doing in or upon the immovable property of the owner or the grantor, something which would, in the absence of such a right, be unlawful, and such right does not amount to an easement or interest in the property, the right is called a license. In other words it is the right granted to a licensee to occupy a house lawfully but there is no transfer of interest (unlike renting).In a leave and license agreement the licensor retains the juridical possession of the premises and the licensee is only in constructive possession of the said premises.
