The marriage which has been solemnized can be registered under the Hindu Marriage Act, 1955 or Special Marriage Act, 1954. If both the husband and wife are of the same religion like Hindus, Buddhists, Sikhs or Jains, they have converted into any of this religion; then the marriage can be registered under the Hindu Mrriage Act, 1955. Under the Special l Marriage Act, marriage can be registered with registrar legally with provisions of the act. Marriage registration processThe marriage between husband and wife can be registered in two conditions either by the solemnization of the marriage in the presence priest and relatives and then registered with the marriage registrar’s office or directly registering the marriage with the registrar’s office i.e. court marriage

  • Solemnized but not registered marriages can apply for the registration with the submission of application along with all mandatory documents with prescribed fees in the registrar office.
  • The marriage certificate will be obtained within 7 days from the registration; the application form can be submitted online for the registration.
  • In case of court marriage, both parties have to submit a joint application with relevant documents at the Registrar office and obtain a date for the registration.
  • The parties will have to present on the given date with witnesses in front of the registrar with required necessary documents.
  • Then the marriage is solemnized and a certificate is issued by the registrar with signature of witnesses and both parties.

The registration of a marriage in a legal system establishes the existence of a marriage according to the Indian law.Document required for the marriage registration:

  • Application form- The application seeking marriage registration needs to be submitted to the Registrar’s office signed by both the parties. Even online submission facility for the application is also available in Delhi.
  • Residence Proof- It is necessary to bring the residence proof any party, mostly the party in whose city is the registration will be done. This residence proof can be anything approved by government like Ration Card or Election Card or Passport. A copy of proofs needs to be submitted with attestation from Gazatted officer.
  • Date of Birth Proof- Admissible proofs like Birth Certificate/ Matriculation Certificate to prove that both parties are of legal age to get married. A copy of proofs must be submitted with attestation from Gazatted officer.
  • 3 passport size photographs of both husband and wife and one post card size marriage photograph.
  • Marriage Invitation Card, if available.
  • Affidavit from both the parties with details like date of birth, Name, Address etc.
