Difference between Lease Agreement and License Agreement

Lease agreement sort of temporarily provides legal possession to the tenant.License AgreementAccording to the section 523 of the Indian Easement Act, 1882, license is defined as a right through which a person grants a person or to number of persons to do/use immovable property for specific use which cannot be done without such right for the property and any such use will be considered as unlawful. License agreement gives out constructive possessions to the licensee while the legal possession rights remains with the licensor. Leave or license agreement do not have any effect on the legal possession right of the owner of the property as they remain with the licensor but it gives right to licensee to use and occupy the property premises for a defined temporary period according to the license agreement.The right of termination of agreement lies with the landlord and to register or legalize the lease or license agreement it is necessary that specific amount of stamp duty must be paid to the registrar’s office.
