State Government Issues Ordinance to Clear Hurdles in Land Conversion

agricultural landMumbai:  In order to clear all the obstacles that comes in the way of land conversion process from agricultural to non – agricultural land, the state government of Maharashtra has issued a regulation amending the Maharashtra Land Revenue Code, 1966.Section 42 of MLRC needs consent from the collector for the use of non-agricultural land. The state government has cleared the requirement with the ordinance. This was done because the process is inconvenient and had resulted in land usage for different purposes without the permission of collector.As per the new issued amendment, in urban zones, there is no need of collector’s permission in case if a plot is part of draft development plan or development plan under Maharashtra Regional Town Planning Act. But there is a need to determine its tenure and any encumbrances by the planning authority and subsequently approve development permission. However collector’s permission will still be compulsory for the citizens who have leased from the government, nevertheless the land conversion process will be made convenient for them.The Maharashtra state earlier, in August 1999 had issued a government regulation for land use conversion. However due to the non amendment of the Act, the issued regulation could not be executed.
