Delhi: HSIIDC has recently revised the property norms of the industrial areas, the authority will impose these norms on the property owners situated across Delhi. Property owners based in Udyog Vihar have challenged new norms of the authority and have also demanded that authority should revise the property norms of the industrial area. The authority also lashed out the HSIIDC authority’s demand for a special fee for illegitimate property transfer and leasing.Sham Sundar Verma, former vice president of the chamber of Industries of Udyog Vihar said that the law states that authority cannot ask for a leasing fee from entrepreneurs owning these plots on a free-hold basis. The authority has imposed the conditions prior to the approval of leasing which is an illegal attempt to subvert section 11 of the Transfer of Property Act, 1882. According to the act, there is no need of permission for leasing or transferring the property once a conveyance deed is signed on a free hold property.The industrial authority charges a leasing fee of about Rs 600 per square meter for the property that has an official permission obtained by the plots owner prior to the application filing. The approach of the authority is very illegal and which needs to be stopped, hence the owners have challenged the authority norms and approach.The industry association has also taken legal alternative action against HSIIDC’s estate management policy and the case was referred by the Punjab and Haryana High Court.
