Pay Dues to get Mandatory Documents

property-registration-cardsMumbai: The Stamp and Revenue Department of Maharashtra has issued a notice stating that the Property Registration Cards (PRC) will become a mandatory document with respect to property registration. The PRC comprises of details of land ownership and authenticates the owner of the property. The PRC will be considered as an indispensable part of the property transaction which proves the ownership of the property. A PRC can be acquired for a plot in accordance to the Right To Information Act 2005. But now, if one wishes to avail PRC then the individual has to clear all the tax dues before obtaining a copy of the ownership card. If the applicant does not settle the land dues then he/she shall not be eligible to obtain a PRC.A signed copy of the PRC will be handed over to the property owner unless he/she has settled the dues. However this shall not be considered as an official proof in case the individual denies being the owner of the property.The PRC is necessary since at times it happens that the BMC gives away approval for building plans which have dues pending. Likewise a check will be kept on the clearance of the dues before the issuance of PRC to the landlord. The department claims that in case an individual refuses to pay the dues, his/her PRC will bear the stamp of ‘Dues not paid’. The PRC is a must in property registration offices of Mumbai.A realty expert has expressed a cross opinion on this saying that the BMC should not levy a penalty on the individual in this manner. An oral assessment should be done to check whether the dues have been paid or not.
