Andhra Pradesh Authority Allows Hibanama for Property Transfers

hyderabad-hibanamaHyderabad: The Andhra Pradesh State Minorities Commission (APSMC) has decided to consider Hiba (Oral gift) as a valid system for transfer of the immovable properties. The APSMC has already issued notices to various government agencies ordering them to consider Hiba as a valid way to transfer the immovable properties.Government agencies which received notices include Greater Hyderabad Municipal Corporation, various district administration offices and the Department of Stamp and Registration. These agencies demanded that the registered documents pertaining to the title of property need to be submitted to the authority while applying for building permissions by producing Hiba.The Muslim personal law states that the immovable property can be transferred when the donor makes an offer and it is accepted by the recipient in the presence of witnesses then the property can be handed over to the recipient. In many cases of property transfer, authorities have asked for the registered documents for the transfer of the properties.The Muslim members are suffering from the various issues related to the property transaction due to the inconsideration of Hibanama for the transfer of the properties in Hyderabad. The Muslim community members are not getting loans from banks and even they are unable to obtain building permissions from several authorities.The APSMC chairman Abid Rasool Khan Said that letters to the RBI has been sent suggesting that proper guideline must be given to its licensed banks informing the validity of Hibanama for the property transactions.
