A housing society can be defined as a group of house owners residing in the same building, apartments or the premises who form a society as per the laws and regulations to have a smooth functioning of utilities and other facilities which are provided to them. A group effort can solve any issue easily and if needed the issue can be taken to higher levels. In a housing society basically all the issues related to the building premises and amenities in it are solved. Once the society is formed as per the Indian laws the members jointly can make the standards to utilize the amenities and other functioning in the premises like cleaning, parking, common area utilization, garden maintenance, etc. These entire standards are made to smoothen the functioning of the society and optimum utilization of the facilities. The housing society formed must be registered with the registrar of the cooperatives. Each estate has its own rules and regulations regarding formation of housing society. If in one premises there is more than one building then they can form housing society of separate building or just one society of all buildings as per the consent of all the members. These housing societies run on the fee that is charged to each flat owner. The amount of fee is again decided by the members of the housing society. This amount collected on monthly basis or yearly basis is used for the betterment of the housing society like repair works, maintenance of amenities and facilities or any extra work. The housing societies have many practical advantages over the flat ownership. The registration of a housing society is a legal process which is required to be done in a specified procedure. There are some agencies that help in formation of societies as they know all the rules and regulations to form a society and can be time saving. These agencies coordinate between the busy builder and the flat owners and thus complete the process of registration and transfer of the builder’s project to the society. The housing society is also responsible for appointing various service providers who take care of the maintenance of the society. The housing society also is responsible for settling resident issues and ensure better functioning of the overall community. Keeping a check on safety measures and maintaining proper accounts of expenses incurred for the well being of the society are some of the other important functions of the housing society.ByRuchi Mahajan (Contributor)займ на карту без отказов круглосуточновзять кредит онлайн

i am a spinster staying in a rented flat in pune. After i started renting the flat my building formed a society and they say they dont want any bachelors staying over there. So do u know any legal way that can help me out because my flat owners are fine with me but the society is not agreeing. Please help!
@ Tabassum
1. If you have a registered rent agreement then no one can pull you out from your flat till the date of end of the agreement. YOu can claim against society if they forcing to leave the flat immediately.
2. If you have notarized agreement or simple stamp paper agreement the you can’t claim your rent possession against society till the end date of the agreement.
Thank you.
dear sir/madam
my building society is planning to repair and new paint for all exterior part of the building. decided amout is 30,000 for each flat. now many members are from normal middle class group, so they decided to pay in installments of 5000 X 6. secretry promised to start a work from May 2012, but till date no outcome. now members have stop paying installments so secretry is charging a penalty of 10% interest on total amount. is this penalty is legal? if yes then 10% is allowed or less then this? request you to pls suggest. your expertise required.

We are having total 09 flats in one building, we want to form society, but builder saying that 09 flats building cann’t possible only appartment can be formed, whether it is true or not please give me information.
Sir,
With special permission of the registrar , you can form the society. But according to me even Apartment Association is a good option. If no are less then its better to form association. In society, you will have to file audits every year, meetings and other procedure is required to be followed.

We ar residing in society and recently one of the flat in our society was rented by its owner and they are running dinind services where many students from outside come and this is causing trouble, security, cleanliness, excessive use of water. Under the society rule such commercial activities are not allowed and hence pl guide how to deal with this, we are not against the person to whom it is rented we just want to stop the dining ( mess or knanawal as is called ) activities run in their house
Sir,
Should send legal notice and file suit for injunction in the co-operative court.
