Farmers certificate whether required to acquire small agricultural land of 15 Gunthas in residential zone in pune ? if yes then what is the procedure.

Farmers certificate means not any kind of certificate, same is 7/12 extract, weather that should be in the name of your father mother and yourself, even the property is in residential zone unless it is converted, into non agriculture (N.A.)

We have purchased a land around 4 years before from two brothers. The land was actually in the name of their Mother, who is no more. They have produced legal hire certificate showing that they are the only, who have the ownership on the land after their parents passed away. We never knew that they have sisters also. We have taken a bank loan and purchased the land. After 3 months of purchase, two of their sisters filed a case for their share. That is the time, when we came to know that they have sisters. Anyways, it took around 1 year for an out of court settlement and two sisters have withdrawn the case. Now when we have started construction, other sisters are telling that they will file a case now. We are now in a state, where we are paying the EMI in the bank but not able to do anything on the land. We have all the legal documents as per land registration department to show our ownership. We have also paid the property tax regularly after purchasing the land. Please let me know a way out of it. My sincere gratitude in advance to those who can show me a way out.

Actually you are cheated by this brothers, it is necessary to file separate case of cheating against them, or settle all the matters, with the help of that brothers, you told you have proper documentation with you, and you are paying tax ….. this is not a question …..one more thing to suggest u, dont left the actual possession of the property, make signage/board on the property, or keep security man, this is necessary things for you.

Hi,
I recently bought a property with 652 sq. ft at Vadgaonsheri, Pune in resale. The previous owner got the posession some where around Aug-Sept 2010. Including this seller, no one in the society has recieved the property tax bill from PMC yet and I heard that PMC have not done the survey yet. Does the property tax is calculated from the date of posession? Do they recover tax from sept 2012? Please let me know.

Sir,
You have to pay property tax from date of possession and previous owner have to pay property tax from their date of possession. You can apply to corporation for assessment of tax.

we have land of 1300 sqft in my mothers name in thane dated 1984 , my mother has sale deed for same, but it is not registered, house was constructed by us without permission of Muncipal corporation. later property tax was levied but it was ilegal rated.we have electricity and water connection in my mothers name 7/12 extract is in name of land lady from whom land was purchase and she is no more, she has one daughter who say i do not need property so stay whout fear and even no will is made nor any such authority is given by landlord lady to me.
land lord lady has given no objection certificate for registration, water, electricity and property tax to be levied on her land.
what we should do to legalise our house it in such case. or put our name in extra in 7/12 extract, so we also become legal heir of house.

legal heir have not in touch with us for last 30 years, do not want to give any such conifrmation, as they are rich people , they do not want such property nor give any thing in writing… what to do in such case. i want house to be legalise. everything we have except regiistered sale deed and 7/12 extract.

Our premises were assessed by pmc and property tax charged there upon by them by around 1996. We have paid all the taxes till date. Now we have received notice which says that tax calculation done earlier was a mistake from PMC and that they have corrected it now. They demand paying of tax difference from the start and have included it in the property dues. We tried contacting concerned officials but have not received any convincing answers. Kindly advice us if this is legally correct on pmc part. Also please guide us as to why should we pay for PMC mistakes and how to treat the matter.

You can directly meet PMC officer for tax in the main building and get the clarification. If the same is not clarified or corrected then you will have to file Municipal appeal.

sir,purchased property 40 years ago and am in possession also.Survey no(gat} as per deed and actual possession are different. city survey office gave demarcation cert 6 years ago.again requested for measurement which they did but did not issue cert. due to inaccuracy of s.no. mentioned above.and gave a letter that survey could not be done of the no. stated in the 7/12 extract.Help please

I have a flat purchased in 1979 in Thane in my mother’s name. But the agreement is not registered. I heard that according to some case in court a property of before 1981 cannot be registered.
So, is it possible to register the agreement(of 1979)? Should i first transfer the ownership to me through Gift Deed and then register the Gift Deed or it is not possible to do so. What should i do?
