Mumbai: The Bombay High Court has awarded a relief in the property tax to all property owners in Mumbai. The grant given by high court will be allowed to owners who pay steep property tax based on the new system introduced in 2010. The high court has allowed these property owners to pay their property taxes under the old un-amended rates with 50 per cent differential between the old rates and new rates.In all 47 petitions were filed by the property owner’s association, societies and individual property owners which were resulted into giving a property tax relief by the High Court Bench of Chief Justice Mohit Shah and Justice M S Sanklecha. Petitions filed by these groups challenged the new property tax system based on the capital value of the property which stated it as arbitrary and unconstitutional.The new system calculates property tax based on the capital value of the property instead of calculating it depending on the rental amount it could fetch throughout the year. The high court had already granted relief to several property owners earlier and it also extended reliefs to some property owners. The high court announced that its order will be applicable to all the property in the city. BMC will accept the property tax in Mumbai without any prejudice to rights of all parties.The high court also de-tagged the petition filed by Bombay Hospital with was amongst the other group of petitions filed by POA and others.
