Marriage Registration Process in Gurgaon

marriage-registrationTraditionally it was accepted in India that the religious ceremony is enough to solemnize a marriage. But after 2006 a marriage is legally null and void if it is not registered. The registration is done under the Hindu marriage act of 1955. The Hindu marriage act is applicable to Hindus, Sikhs, Buddhists and Jains or to people who have converted to any of these religions. People belonging to religions other than these are married under the special marriage act of 1954.Marriages do not need to be registered only because they are legally required to be done so. Registration of marriages has various other benefits:

  • The registration certificate acts as a legal proof for obtaining passports and visas.
  • It is important for applying for loans
  • Tax exemptions and employment benefits can be availed using the registration certificate.
  • The process of property inheritance subsequent to spouse’s death is made easier with the registration certificate
  • Adoption process is made easier
  • In case of divorce or any other legal action by one spouse against the other makes the marriage registration certificate a necessity

Procedure:The procedure and the time taken to register a marriage and obtain the marriage registration certificate may vary from one jurisdiction to the other the basic procedure and the document required basically remain the same.Marriage registration in Gurgaon:In case of court marriages one needs to be of the legal age that is 21 for men and 18 for women. Apart from these they need legal documents such as the:

  • Date of birth proofs of both bride and bridegroom (birth certificate, school certificate, passport, self affidavit regarding age if birth/school certificate is not available)
  • Proof of residence (Voter I-card, Ration card, BPL card, Passport, Driving License, Domicile Certificate)
  • Recent two passport size photograph of both bride and bridegroom
  • Application form filled up and signed by both bride and bridegroom
  • Six Affidavits each of :

1. Bride2. Bridegroom3. Father or Mother (bride)4. Father or Mother (bridegroom)5. Relative or Friend (bride)6. Relative or Friend (bridegroom) all attested by the Executive MagistrateIn case the marriage has already been solemnized one also needs: 

  • 3 wedding photo post card size clearly depicting marriage of bride & bride groom
  • Marriage invitation card if available
  • A certificate from the priest is required who solemnized the marriage

In case one of the parties is a divorced or widowed then the original copy of divorce decree/order in case of a divorcee and death certificate of spouse in case of widow/widower is also needed.For marriage registration one can apply at the Citizen Facilitation Center, Municipal Corporation Gurgaon which remains open between 7:00 am and 7:00 pm, 7 days a week or they can apply online at www.mcg.gov.inForm 1 for court marriage can be obtained from the court for Rs 10. The registration fee is Rs 100 if the marriage is registered within 90 days from the date of marriage. Between 90 days and 365 days of the marriage the fee is Rs 250.
