Patna: High-rises on narrow roads can cause several civic complexities. Keeping this in mind the Patna High Court has issued an order on to the state government that height of buildings will be capped according to the width of the roads along which they are situated.According to the order, roads with a width less than 20 feet should not have buildings more than 11 meters tall. 40 feet wide roads should not have buildings more than 16 meters high. The order comes in the wake of a PIL filed by Narendra Mishra who challenged the Patna Municipality Corporation’s (PMC) decision of allowing the construction of a 16.4 meter high multi-storey building on a road with a mere width of 11 feet. This occurred on the Raiji Ki Gali in East Boring Canal Road locality in Patna.The Patna high court has been outraged by such open flouting of rules and has pulled up the PMC authorities to find the persons responsible for such irresponsible non-compliance with the rules. For future constructions, in the light of the present PIL the court has passed the general orders that will control the construction of buildings in Patna. The division bench which comprises of Justice Navin Sinha and Justice Shivaji Pandey, questioned the PMC as to how the architects sanctioned the designs of the multi-storey in question to be constructed.The court is now trying to fix the responsibilities of the PMC staff and engineers so that in the future in case of any such error people who are responsible for flouting the rules can be easily pointed out and penalized.The builder of the building in question not only flouted the rules that dictate the height but also encroached on the adjoining part of land which is a part of the Patna Master Plan and is reserved for the construction of a 60 feet wide road. Subsequently the construction of the building has been stayed by the court.The court is also distressed by the commercial use of residential buildings.
