Mumbai: The Maharashtra State Consumer Disputes Redressal Commission has resolved a long standing consumer complaint and has ordered a well known builder to pay a compensation amounting to almost 2 crore to complainants who never received the possession residential units in Thane they paid for in 1997.In 1997 the builders Paranjape Construction Company came up with the proposal of constructing ‘Paranjape Nagar’ which was to be a project with multi-storied buildings, bungalows and row houses. At that time the complainants paid Rs 50,000 to Rs 3 lakhs in advance but the project never took off. The builder had some strife with the villagers from whom the land was to be taken. Also the builder could not acquire the required approvals from either the government or the local bodies. The complainants requested and issued notices several times to the builder to refund their money but the builder did not budge. Finally a complaint was lodged in 2009 with the Maharashtra State Consumer Disputes Redressal Commission.While the complaint was pending in the forum some of the complainants died and were replaced by their legal heirs. The builder was sent several notices from the forum but no representation was made from the builder’s side. The order was therefore passed ex parte by the Commission. The Commission passed the decision in support of the complainants as it is of the opinion that since the builder did not refute the allegations, it functions as a submission to deficiency in service.The commission said, “Having received part-consideration from each of the complainants and failure on their part to complete the construction work and hand over possession of the respective tenements, the opponents are under statutory obligation to refund the amounts received, together with reasonable interest.”The Paranjape Construction Company will now have to return an average of Rs 1 lakh to each of the 82 complainants.
