Patta – A Necessity

Patta is nothing but a revenue record. It is an extract which is issued from the Register of Land holdings maintained, generally at the Tahsildar’s office. Patta is issued in the name of the person/ persons in whose name the records related to the hoardings are maintained. Patta is an instrument that showcases possession of a particular property.Rights to a property may be conferred in the following 3 ways:1.  Through Voluntary Act of Parties: the transactions falling under this classification are the ones that are covered by the Transfer of Property Act.2.  Inheritance or Bequest: laws related to succession cover this type of property rights.3. Orders of Courts: Rights to a property can also be conferred by orders of courts, state action, tribunals and so on.Also, there are three levels of documents which support claims to the title: title documents, approvals or other municipal records and revenue records. Obtaining Patta depends on the nature of the property and its possession. It can be obtained in respect to the above mentioned transactions.Importance of Patta: Issuing Patta signifies that you have a legal possession over the property. Patta is issued in the name of the owner/ joint owners. Patta can be used as evidence in cases of conflicts with the Government or any other third person regarding land. In cases where the Government wishes to acquire the land, it has to do compensatory payment to the Patta holder as he has the first right to the property. Patta is also the main determinant of the ownership of the property in case of sale of the property.Procedure to Obtain Patta:

  • One has to apply to Tahsildar in the form of a simple requisition to issue the Patta.
  • It is also compulsory to provide the necessary documents and details related to the property.
  • The concerned officer can also conduct a survey of the property/ land before granting the Patta.

Is Patta Compulsory for Every Property?Patta is the prime document for establishing legal possession. It is compulsory in cases of vacant plots. Patta is also a must in cases of properties with structures and buildings. Patta not only states the legal ownership of a property, but it also includes the other important details of the property, for example, measurements of the property, extent of the holding and so on.Do Apartment Owners Need Patta? Patta is mostly related to land and not buildings. However, Patta at times includes particulars related to buildings. Patta cannot be obtained by each individual living in the building, but it is possible to obtain Patta in the names of all the co-owners jointly.Can a Patta be transferred?      In case a Patta owner dies without leaving a will, the legal heir of the deceased person is entitled to have a Patta for the property in his/ her name.If the person has left his will behind, then it is transferred to the beneficiary with the consent of others who will be the immediate heirs of the deceased person.In case of purchase/ sale of a property, the Patta can be transferred in the name of a purchaser or a transferee.     займ на карту без отказов круглосуточновзять кредит онлайн
