The project was a part of cross-subsidy scheme for providing homes to 344 families of Shanti Nagar apartments to new buildings free of cost in the year 2009-10. Many investors had paid few crores to buy homes in the towers.Due to some security concerns, the prison authorities decided to terminate the project\u2019s commencement certificate as Shanti Nagar is just at distance 18 mts from the jail compound walls. The project developer said that it has already invested Rs. 70 crore and has built the foundation after receiving the obligatory clearances in 2010.According to Maharashtra Jails Act 1979, construction within 183mts from the compound wall is banned. The current Model Jail Regulation 2003 has reduced the distance to 150mts from the main defense wall.The senior prison authorities said that if the government grants permission for construction then it can pose threat to the jail. The inside of the jail will be clearly visible from the 72 storey building.The petition said that two slum rehab buildings of 7 floors have already been constructed within 18mts of jail\u2019s north wall. The authorities without thinking about the security issues are granting permissions for development of projects in the vicinity which includes the planned monorail too. The act is arbitrary, baseless, illogical and biased.
