With an estimated 30 million non resident Indians living across the world, Indian real estate is highly appreciated for the NRI investment prospects. With higher incomes NRI\u2019s get an advantage of lower price property rates in the Country which is attracting more and more NRIs to invest in the Indian Real estate.There are several regulations and restriction for NRIs while investing in India. According to these regulations of RBI and FEMA, a NRI is allowed to invest in Indian Real Estate with the support of a few significant provisions. If you are a NRI, the question that arises in your mind is \u2018how can a NRI invest in the real estate of India without any legal hassles\u2019.<b>Where and how to own a property? <\/b><\/p>\n<ul>\n<li>NRI\u2019s can invest in any immovable property except for agricultural lands, farm houses and any such property which could be used for plantations. The ownership of such properties can also be allowed for NRI if the property is gifted by an Indian resident, Indian citizen residing outside India or by any person of Indian origin.<\/li>\n<li>If the NRI gets a property of any kind via inheritance then he is allowed to keep that property although it may be an agricultural land or any similar plantation property.<\/li>\n<li>NRI\u2019s can transfer such inherited farm house, agricultural land, or any plantation land as a gift to any Indian resident. He\/She is also allowed to transfer residential or commercial property by means of gift to any person who is a resident of India or a NRI<\/li>\n<li>NRI\u2019s can transfer any immovable property by sale to any Indian resident<\/li>\n<\/ul>\n<p><b>Financial Sources for NRIs<\/b>NRIs can pay the purchase price for properties via their NRO or NRE accounts in India. NRE account stands for <b>Non-residential External<\/b> account through which foreign currencies are converted into Indian rupees. The account is a Rupee denominated account and funds in NRE are freely repatriated. NRO account is also a denominated account which is used to transfer Indian Earnings.Various financial institutes provide finances to the NRIs to invest in Indian real estate as NRIs can pay back the loan amount easily. The repayment of any amount can be done through the NRE and NRO accounts. Maximum 80 percent of the actual purchase price is financed to the NRIs by financial institutes as a home loan.<b>Tax system for NRIs<\/b>NRIs will have to pay the stamp duty as well as registration fees while purchasing the property in India. NRIs will have to pay applicable taxes if he is currently living in the country wherein worldwide income is taxable and that country must have had a Double Tax Avoidance Agreement with India. Other than this the Indian tax system has several twists and turns for NRIs. There are various provisions for taxable properties set by the Income tax act.Fall in the value of Indian rupee in global market has invited higher NRI investments.
