The transfer of the title of ownership can be done in certain conditions like death of the previous owner, sale\/purchase of the property etc. Mutation means alteration in the entries of the revenue records.By means of mutation, the owner will get the property ownership in his name so that the Government can charge the property tax to the rightful owner.The new owner has to pay the transfer duty on the respected amount. They also require to pay appropriate mutation fee for each apportionment. Mutation is permitted on payment of up-to-date dues, in case if complete plot or building is sold.Mutation records are very important records for the land owners as well as the Government. Land mutation means alteration of the ownership of the land under certain conditions.<b>Why Land Mutation is required?<\/b><\/p>\n<ul>\n<li>The mutation of the land can give a person the rights of the land<\/li>\n<li>To prove the ownership of the land, person needs to present the land mutations records in his name.<\/li>\n<li>Government can charge property taxes depending on the land mutation records.<\/li>\n<\/ul>\n<p>Mutation is required under the following conditions<\/p>\n<ul>\n<li>Sale or Purchase of the property<\/li>\n<li>Exchange<\/li>\n<li>Partition of Holding<\/li>\n<li>Inheritance or succession<\/li>\n<li>Will<\/li>\n<li>Acquisition under the Land Acquisition Act<\/li>\n<\/ul>\n<p><b>Which offices support the mutation process?<\/b>The mutation of lands comes under the revenue department of any state government and most of the mutation transactions are carried out at the offices of Tehsildar\/Naib Tehsildar of respective area where the land is situated.<b>How to apply for property mutations?<\/b>Any person with legal permission for the property mutation can apply for the property mutation. While applying for the mutation person needs to submit applications to the tehsildar on a plain paper with a relevant value non judicial stamp.In the application following details should be entered while applying for the mutation<\/p>\n<ul>\n<li>Name, Parent&#8217;s name along with the address of the person from whom the property right has been acquired<\/li>\n<li>The area in which the land rights are acquired<\/li>\n<li>Description of the right acquired<\/li>\n<li>Name, Parent&#8217;s Name along with address of the person who has acquired the right<\/li>\n<li>Date of the transaction<\/li>\n<li>Copy of the documents showing the land transactions like Sale Deed, Will etc.<\/li>\n<\/ul>\n<p>A proclamation is issued inviting objections to the proposed mutation specifying the date with minimum 15 days of limit. If no objection is observed then the mutation of the property is sanctioned by revenue department but if any objection occurs then that party can file an appeal against the mutation process within 30 days.<strong>Documents which are required in the process of property mutation under different conditions<\/strong>Commonly required documents<\/p>\n<ul>\n<li>Application for mutation with relevant stamp<\/li>\n<li>Indemnity bond on stamp paper of requisite value<\/li>\n<li>Affidavit on stamp paper of requisite value<\/li>\n<li>Property tax payment receipts<\/li>\n<\/ul>\n<p>In case of sale and purchase mutation copy of sale deed must be presented for the mutationIn case of will or the inheritance of the property following documents are also required<\/p>\n<ul>\n<li>Death certificate<\/li>\n<li>Copy of succession certificate or will<\/li>\n<li>Copy of power of attorney\/copy of will<\/li>\n<\/ul>\n<p><strong>Where to register complaints regarding land mutation?<\/strong>To register your complaints, you can either contact Tahasildar \/additional Tahasildar or you can contact the concerned sub-collector.Respective property\/ land mutation charges and rate of transfer on the consideration amount should be paid.
