A complete halt had been put on the transfer of industrial plots in Noida when the green tribunal, in a drive to arrest increasing pollution levels in Noida had put a ban on setting up new industries as well as expansion of old ones in April 2012. This move halted the execution of around 250 industrial units in Noida. Now the green tribunal has ordered the Noida Authority to clear the pending transfer requests but only on the condition that the new owner of the land cannot to anything that will harm the environment.The new owner will be liable for any pollution caused by him and will have to pay appropriate compensation for the damage he causes. The Noida Authority is allowed paper transfer of the industrial plots after determining that the new undertakings will be of a non-polluting nature. The new units will be allowed to begin operations only when they procure no-objection certificates from the Uttar Pradesh Pollution Control Board (UPPCB) which is approved by the green tribunal.The order of the bench headed by Justice V.R. Kingaonkar clearly states, &#8220;We make it clear that whatever transfer is effected through the agency of Respondent No. 5 [Noida Authority] will be only a paper transfer and that too without change of the responsibility of civil and criminal consequences whatever may arise.&#8221;The tribunal has also instructed the Central Pollution Control Board to form a committee to examine cases which involve polluting industries.
