Anybody who doesn&#8217;t should become aware of it. It is an agreement between the owner of the house and the future tenant about the terms and conditions of occupation. A rent agreement in general consists of certain basic terms and conditions that are decided between the lessor and the tenant such as the period of tenancy, amount of rent, deposit, mode of payment, increment of rent, utility charges, payment for damage etc. It is a binding agreement for both the owner and tenant.Though most people know about these key factors being stated in a rent agreement, often various small but essential things are overlooked while signing a rent agreement leading to major inconvenience.Some points to check before finalizing a rent agreement:<\/p>\n<ul>\n<li>The agreement should clearly mention the time for which the agreement remains valid, when it will be renewed, time after which rent can be escalated and by how much. Usually an agreement remains valid for 11 months after which it had to be renewed for the tenancy to continue. For an agreement to remain valid for more than a year the owner has to register the related documents.<\/li>\n<li>Before signing a rent agreement make sure you are signing it with the original owner of the house and not with a third party. Often many owners whole possibly live too far from their properties or are NRIs trust caretakers to take care of their properties. These caretakers in turn use these properties for renting out and pocket the money. This is an illegal activity as the caretaker has no authority to sign any agreement with anyone because, to start with, the property is not his. In case the actual owner comes to know of the circumstances he has the entire legal right of evicting the tenant as occupying any property without the consent of the owner is equal to trespassing.<\/li>\n<li>Check all documents properly before signing an agreement. Such documents include sale deed, share certificate, No Objection Certificate (NOC), utility bills and other documents. Check that all the previous bills relating to the house had been paid. In this case the most important thing to check is that all taxes that have to be paid for the house had been paid by the landlord. Apart from this also check that previous electricity and water bills had also been settled.<\/li>\n<li>Before moving in, if you have any requirements such as the house has to be repainted or some damages have to be fixed, it is best that you ask the owner to take care of these before signing the agreement or include these terms in the agreement and make the owner sign it. In case of small problems in electrical connections or bathroom fittings it is usually the tenant&#8217;s responsibility to take care of these.<\/li>\n<li>In case you are renting a house in a housing society chances are that you may have to pay the society a certain maintenance fees for the society. Usually the owner of the house has to pay the bill but you may as well clarify the facts in the rent agreement. Some societies charge for the use of the gym, swimming pool or other facilities available.
