The decision has been finalized by an order from the <a href=\"http:\/\/www.bharatestates.com\/delhi\/real-estate\" target=\"_blank\">Delhi<\/a> High Court. However some of the allottees will have to face disappointment as the High Court has refused to order the granting of completion certificate to 28 flats which are a part of excess construction by the Emaar MGF.<\/span>Justice G.S. Sistani said that the balanced flats will receive a completion certificate and will be handed over to the petitioners (Commonwealth Games Village Allottees Welfare Association and other allottees). But the 28 excess flats built by the Emaar MGF will be held as security by the court till the private developer pays the market price for the construction of the excess area.The purchasers were unable to take possession of the flats as the DDA had refused to grant completion certificates. Two separate pleas were filed in the Delhi High Court, one by CWG Village Allottees Welfare Association and another by a group of other allottees who could not get possession of their flats in spite of having made all the payments. The High Court decision came as a disposal of these pleas.The court has ordered DDA to &#8216;regularize&#8217; the excess construction as the demolition of these flats will cause major inconvenience to about 1,168 flat owners.The DDA has also decided to pull down and reconstruct unsafe buildings in five areas around Delhi on the basis of a survey by the Disaster Management Authority. These five areas are Lalita Park, Kondli, Gandhi Nagar, Lal Kuan and Fatehpur Beri. These areas have witnessed frequent collapse of old, depleted buildings in the recent times.
